The conundrum of no jab no job.

Post by billy the kid » Thu Aug 12, 2021 5:21 pm

At the risk of being criticized for another conjob19 thread, perhaps this topic
needs more than passing attention.
We all know that pursuant to occupational health and safety rules and regulations,
employers in Australia have a duty to provide a safe and proper work place environment.
We also know that an employer can (apparently) mandate the jab for his employers
if he thinks it is reasonable to do so.
This step would be taken bearing in mind the close proximity of staff to one another
and the space each and every one of them works in and the specific type of employment..
My question is this....
If an employer mandates the jab for his staff, isnt it almost a given that he
will have to enforce a no jab no entry rule for his clientele.
Think about it...
How can he demand staff get the jab to provide a safe and proper workplace
environment, but then NOT mandate the same for his clientele.
He's only doing half the job as clientele could enter his premises with the virus
and give it to his staff...
Therefore he has not provided a safe and proper workplace environment.
Will all clientele have to wear a mask simply to remain clientele.
This is not the same as a mandatory jab.
These two issues go hand in glove...
I wonder if employers/employees realize that...
Imagine a no jab no job mandate and then no clientele...
The staff have been jabbed...but perhaps then the business folds...
This will be a conundrum....

I agree and also I keep worrying about indemnity.

If businesses, especially smaller businesses, mandate the no jab no job 'rule.' Who is liable if a healthy young man with a wife and kids to support and a mortgage etc gets terribly sick and/or dies?

It won't be the government, the doctor who jabbed them or the pharmaceutical companies.

I think that question may end up in the High Court as a test case.
There are 1000s of vaccine injuries too where the person doesn't die
but gets some awful medical problem.

They probably think that if a customer gets Covid from an employee, who they've made have the jab, then they will be safe from liability. Backward thinking and this is going to blow up in their faces.

https://www.timesofisrael.com/tv-14-isr ... -covid-19/

Fourteen Israelis have been diagnosed with COVID-19 despite
having been inoculated with a third COVID-19 vaccine dose.

Two of those infected after receiving the booster shot have been hospitalized.

Fair Work Australia have virtually approved no jab no job workplace possibilities
in the future with a three tier "suggestion" for various businesses/occupations...
Those people working in businesses of less than 15 employees with employment history of less
than 12 months have always been on shaky ground...
That ground will be even shakier now if an employer introduces a no jab no job
condition of employment....
Let the shit fights begin....
I think a lot of people in Australia could be changing jobs by the end of the year...
