Lawyers at a Delhi court have said they will not defend the six people standing trial for the gang-rape and murder of a 23-year-old medical student whose case has shocked the country and provoked a national outcry for safety of women.

Hearings are expected to begin on Thursday at the Saket district courts, where the Delhi Police will formally present a 1,000-page chargesheet against five men facing the charges. The sixth, believed to be a juvenile, would be tried in a juveniles'' court, but the police are conducting bone tests to determine his age.

"We have decided that no lawyer will stand up to defend them. It would be immoral to defend the case,"

That was the worst news I heard over the holidays.

It is indefenceable and I can understand why no lawyer wants to touch it. They should be entitled to a court appointed representation to ensure a fair trial but I expect that defence would focus on minumising the sentence rather than their innocence.

I'm for the death penalty in this sort of case. Such scum have forfeited the right to their own lives..

I want them to be fairly represented so there is no appeal possible due to them having a lack of representation.

Evidence needs to be submitted, accounted for and defendants represented otherwise I could make a statement that Aussie was on that bus just because I think he deserves to be housed with bubba in the big house so his bowel movements are involuntary for the rest of his life...but although he deserves involuntary bowel movements, he needs to have that happen justifiably. A random raping is more justifiable due to karma than false imprisonment in that case, although no less deserved.

I wouldn't shed any tears either way

They need representation. Can you imagine if one of them got away with it by arguing a miscarriage of justice? Or if an innocent bystander accidentally got lumped in with them? Those lawyers need to harden up.

Using the morality issue is a bit of a furphy. Rape and murder is rampant in India so until this case made world headlines, a lawyer wouldn't have thought twice about defending the perpetrator/s.

Lawyers are refusing to defend these men on the basis of their businesses knowing that if they did - they would lose clientele and be ostracised.

Let them use the services of the international lawyers, for the sake of Justice, since no Indian can be seen to be defending their behavior.

I think that embodies the most 'popular' misconception people have about the professional and ethical obligation lawyers have. We do not defend anyone's 'behaviour.' We are in Court as their Lawyer to ensure they receive their full legal entitlements, to protect their legal rights, and to make whatever submissions there are by way of mitigation/explanation for whatever conduct they have either admitted to by way of guilty plea or have been found guilty of, after conviction.

That Indian Lawyers are refusing to do their professional job (for fear of whatever) is just another indication of how, in many ways, the Indian Judicial/Political/Social relationship is fucked up.

India inherited their legal system from the British. It is adversarial with a local flavour. (like more corruption and indian values which is diverse and regionalised) The core of their system is similar to Australia, just as a guide fro you all.

Their system is slow and so backed up that it fails to deliver justice in a timely manner. Good to see that have implemented a fast track system for such cases.
